The government is considering a plan to give 16 weeks of maternity leave for women adopting children up to three months and commissioning mothers who use surrogates to bear children.

In a written response to Rajya Sabha, Minister for Labour and Employment Bandaru Dattatreya said: "A proposal to provide 16 weeks of maternity benefit to a woman who legally adopts a child up to 3 months of age and to a commissioning mother is under consideration of the government.”

The minister was responding to a question if the government has plans to extend maternity leaves to women employees opting for adoption or commissioning mothers.

To a separate question on rising maternity benefits, Dattatreya said: "A proposal to increase maternity leave from existing 12 weeks to 26 weeks under the Maternity Benefit Act will benefit women employed in the establishments covered under the Act."
The minister offered the clarification to a query whether the proposal to increase maternity leave would only benefit  25 per cent women employees in the formal sector.
